The ceremonial setting of the naturalization
The presentation of the naturalization certificate should take place in a special and dignified setting. For this reason, it is planned that this will take place during a public naturalization ceremony. This ceremonial act marks the official and final step on the path to German citizenship.
The decisive moment
Naturalization becomes legally effective at the exact moment the naturalization certificate is handed over. Only with this handover are you officially a German citizen. This is a so-called legally formative administrative act, which means that this act establishes a new legal relationship, namely German citizenship.
The solemn confession
Before the certificate is handed over, a solemn declaration must be made. This declaration emphasizes the commitment to the values and laws of Germany.
The wording of the confession
The declaration, which is made orally, reads: "I solemnly declare that I will respect the Basic Law and the laws of the Federal Republic of Germany and will refrain from doing anything that could harm it."
Purpose of the confession
This declaration of allegiance, which was already made in writing during the application process, is reaffirmed personally and in a festive setting. It symbolizes the conscious decision to become part of the German community of law and values.
Exceptions to the duty of confession
Not everyone has to make this confession personally. There are exceptions for certain groups of people.
Minors under the age of 16
Children and young people who have not yet reached the age of 16 are exempt from the obligation to make the solemn profession of faith.
Persons not capable of acting
Persons who are deemed incapable of acting under the law are also not required to make the confession. In these cases, the procedure is conducted by their legal representatives.
The certificate and its presentation
The naturalization certificate is the central document that certifies the acquisition of German citizenship. Its form and the way it is handed over are clearly regulated to ensure legal certainty.
Form of the certificate
The naturalization certificate is issued on a special form. It cannot be issued in electronic form for security reasons and to avoid forgeries.
Handover procedure
The certificate must be issued by the competent citizenship authority and handed over to the person to be naturalized.
Personal handover
As a rule, the certificate is handed over to the applicant in person. This usually takes place during the naturalization ceremony.
Handover to legal representatives
For children who have not yet reached the age of 16, the certificate is handed over to the legal representatives, i.e. usually the parents.
What happens if I refuse to confess?
If a person refuses to make the solemn declaration of faith, the naturalization certificate will not be issued to them. Naturalization does not take effect if the certificate is not handed over.
Exemption rule for handover
If it is not possible to hand over the certificate in person for important reasons, it can also be delivered formally, for example by post. In such a case, the solemn profession can also be made in writing. It is important that the time of delivery is documented in a legally secure manner.
The importance of the correct procedure
For naturalization to be effective, it is crucial that the certificate is officially issued by the competent authority with the will to naturalize.
- If the document comes into the possession of a person only by mistake or without the will of the authorities, the naturalization does not become effective.
- A simple verbal or written notification of successful naturalization cannot replace the formal handing over of the certificate either.
